Power of Attorney
There are two main types of power of attorney that cover different scenarios when you may need others to make decisions and sign on your behalf.
A power of attorney can only be made whilst you retain full capacity to make your own decisions.
- General or Specific Power of Attorney is used when you are not physically present to sign or make decisions. – for example; if you are out of the country and cannot sign legal paperwork. This power does not continue if you lose capacity.
- Lasting Power of Attorney is a legal document made by you the Donor allowing you to choose someone (the Attorney) to make decisions on your behalf about things such as your property and affairs or personal welfare at some point in the future when you no longer wish to make those decisions or lack the capacity to do so.
There are two different types of Lasting Power of Attorney:
- Health and Welfare
- Property and Affairs
