Power of Attorney

A Lasting Power of Attorney is a legal document made by you the Donor allowing you to choose someone (the Attorney) to make decisions on your behalf about things such as your property and affairs or personal welfare at some point in the future when you no longer wish to make those decisions or lack the capacity to do so.

There are two different types of Lasting Power of Attorney:

  • Personal Welfare Lasting Power of Attorney
  • Property and Affairs Lasting Power of Attorney

An existing Enduring Power of Attorney allows the Donor to appoint a legally authorised person to look after their property and financial affairs should they become incapable of doing so themselves at some point in the future. It continues after the Donor has become mentally incapable of managing his or her affairs and must be registered when the Attorney becomes aware or has reason to believe that the Donor has become or is becoming mentally incapable.
